GENERAL TERMS AND CONDITIONS

I. SUBJECT

 

Article 1. These general terms and conditions regulate the relationships between Raimar Ltd., registered in the town of Kresna, 90 Vardar Street, UIC 101784563, represented by Boyan Smilenov (hereinafter referred to as the "SUPPLIER"), and the customers (hereinafter referred to as the "CUSTOMERS") of Raimar Ltd. through its electronic store: www.raimar.bg.

 

II. DETAILS OF THE SUPPLIER

 

Article 2. Information pursuant to the Electronic Commerce Act and the Consumer Protection Act:

 

  • Supplier Name: Raimar Ltd.

  • Registered Address and Headquarters: Town of Kresna, E-70 Main Road, near EKO gas station opposite the railway station.

  • Showroom and Advisory Center: Sofia, 9 Boris Arsov Street (ground floor).

  • Business Address: Town of Kresna, E-79 Main Road, near EKO gas station.

III. CHARACTERISTICS OF THE ELECTRONIC STORE

 

Article 3. The electronic store is accessible online at www.raimar.bg, where customers can browse, inquire about, and order goods offered by the Supplier. The following activities are supported:

 

  1. Submit electronic inquiries through the website interface.

  2. View the products, their characteristics, prices, and delivery conditions.

  3. Be informed about consumer rights, mainly through the website interface.

  4. Place orders using the website interface to conclude contracts with the Supplier for the offered goods.

 

(1) The purchase contract is deemed concluded upon confirmation of the order by the Supplier.

(2) In cases of stock unavailability, the Supplier reserves the right to decline the order.

(3) After selecting one or more products offered on the Supplier’s website, the Customer must add them to the shopping cart.

(4) The Customer must provide delivery details, select a payment method and time of payment, and confirm the order through the website interface.

(5) Upon placing an order, the Customer will receive confirmation via email or Viber.

(6) The Supplier reserves the right to refuse to conclude a contract with a non-compliant Customer.

(7) The Supplier may deem a Customer non-compliant in cases of:

  • Non-adherence to these General Terms and Conditions.

  • Demonstrated improper, rude, or offensive behavior toward the Supplier’s representatives.

  • Fraudulent or deceptive actions by the Customer against the Supplier.

 

Article 4. The Supplier may deliver goods via courier and guarantees the Customers’ rights as provided by law, in good faith and in accordance with established commercial and consumer practices.

 

Article 5. (1) The Customer and Supplier communicate order details through email, Viber, phone, or other remote communication means.

(2) Customers pay the Supplier for delivered goods as per the order and these General Terms and Conditions.

(3) Transport costs are determined separately from the product price and depend on the quantity and delivery location.

 

Article 6. (1) The Customer and Supplier agree that all communications between them regarding the conclusion and execution of the order may be conducted electronically under the Electronic Document and Electronic Signature Act and Article 11 of the Electronic Commerce Act.

 

IV. USE OF THE ELECTRONIC STORE, PAYMENT, DELIVERY, AND SPECIFICATIONS OF NATURAL STONE

 

Article 7. (1) To submit an inquiry or order through the ELECTRONIC STORE, the Customer must provide their name, email, phone number, and delivery address.

(2) The delivery address is specified by the Customer by completing the online order form on the Supplier’s website or later after order confirmation.

(3) By entering their details and selecting the button:

I agree to the terms and conditions and the privacy policy of the website,

The Customer declares that they have read these terms and conditions, agree with their content, and undertake to comply unconditionally.

(4) Upon submitting an inquiry, the Customer is obliged to provide accurate and up-to-date information.

 

Article 8. The provisions of this Section IV apply to Customers who are consumers under the Consumer Protection Act, the Electronic Commerce Act, and/or Directive 97/7/EC of the European Parliament and Council dated May 20, 1997, concerning consumer protection in distance contracts.

 

Article 9. (1) The main characteristics of the goods offered by the Supplier are detailed in the product profile on the ELECTRONIC STORE website.

(2) The prices of the goods, including all taxes, are indicated in the product profile on the ELECTRONIC STORE website.

(3) The cost of postal and transport services, if not included in the product price, is determined by the Supplier and provided to the Customer electronically at a later stage via email, Viber, or phone. Delivery costs outside Bulgaria are negotiated additionally.

(4) The payment, delivery, and execution methods are declared in the order or the proforma invoice provided to the Customer.

(5) If the delivery address is incomplete, incorrect, or contains errors in the address and/or phone number provided during the order, any additional transport costs incurred due to redirection will be at the Customer’s expense.

 

Article 10. (1) The Customer agrees that the Supplier may require and accept advance payment.

(2) The Customer may choose to pay for the delivery of goods either in advance or upon receipt.

(3) Payment methods include cash on delivery or bank transfer.

 

  • Cash on delivery: The Customer pays an additional courier fee of 2% of the cash-on-delivery amount, noted separately in the order confirmation sent to the Customer.

  • Bank transfer: The Customer receives a proforma invoice with all necessary bank details to arrange payment before order dispatch.

 

Article 11. (1) The Customer has the right to withdraw from the order within 14 days of receipt without incurring penalties or specifying reasons. In such cases, the Customer is only responsible for the cost of returning the goods.

(2) The right of withdrawal does not apply in the following cases:

  • Goods whose price depends on financial market fluctuations beyond the Supplier’s control.

  • Goods made to the Customer’s specific requirements or custom orders.

  • Goods that have been installed, used, or otherwise consumed and cannot be returned without affecting their quality.

 

V. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

 

Article 18. (1) The Supplier may amend these General Terms and Conditions and will notify all Customers with pending orders accordingly.

(2) Any modifications will take effect after notification and provided the Customer does not reject them within a 14-day period.

Article 19. The Supplier publishes these General Terms and Conditions on www.raimar.bg.

 

VI. TERMINATION

 

Article 20. The General Terms and Conditions may be terminated under the following circumstances:

  • By mutual agreement in writing.

  • Unilateral notice by either party in cases of breach of obligations.

  • Force majeure events preventing the fulfillment of obligations.

 

VII. FINAL PROVISIONS

 

Article 21. The invalidity of any provision of these General Terms and Conditions shall not invalidate the entire document.

Article 22. Bulgarian law governs any matters not addressed in these General Terms and Conditions.

Article 23. Disputes arising under these General Terms and Conditions will be resolved by the competent court or the Consumer Protection Commission.

Article 24. These General Terms and Conditions are effective as of January 1, 2025.
